By creating an account or otherwise using vtube.chat (the “Service”) you agree to these Terms. If you don't agree, don't use the Service.
1. The Service
vtube.chat provides browser-based and desktop AI conversation tools with text, voice, and avatar rendering. The Service routes requests through third-party AI providers (Anthropic, OpenAI, Together AI, ElevenLabs) under our agreements with them.
2. Your account
- You must be at least 13 years old (16 in the EEA/UK).
- You're responsible for the security of your password and for all activity under your account.
- You may use only one account per natural person unless we authorize otherwise in writing.
- Notify us at matt@pruitt.life if you suspect unauthorized access.
3. Acceptable use
You agree not to use the Service to:
- Generate content that is illegal in your jurisdiction or ours, including child sexual abuse material, content that incites violence, or content that infringes others' rights.
- Generate content depicting real people without their consent.
- Send spam, phishing, or malware.
- Probe, scan, or otherwise attempt to circumvent the Service's tier limits, authentication, or rate limits.
- Resell or redistribute Service output as if it were your own product without substantial transformation.
4. Tiers, billing, and cancellation
- The free tier is offered at no charge subject to daily caps (visible on your account page). We may change caps with notice.
- Paid tiers (Base, Pro) are billed monthly through Stripe. Charges are non-refundable except as required by law.
- You may cancel at any time from your account page; access continues through the end of the paid period.
- We may suspend or terminate accounts that violate these Terms, with refund only of unused prepaid time when termination isn't for cause.
5. Content ownership
You retain ownership of the prompts you provide. Output generated by the underlying AI models is yours to use, subject to applicable law and the licenses of the underlying models. You grant us a non-exclusive license to process your inputs and outputs as needed to operate the Service (storage, retrieval, transmission to providers).
We do not use your conversation content to train AI models. Conversation content is encrypted at rest with AES-256-GCM.
6. Disclaimers
The Service is provided “as is” without warranty of any kind. AI output may be inaccurate, biased, or offensive. Do not rely on Service output for legal, medical, financial, or safety-critical decisions. You assume the risk of using Service output.
7. Liability
To the maximum extent permitted by law, our aggregate liability arising from your use of the Service is limited to the amount you paid us in the twelve months prior to the claim. We aren't liable for indirect, consequential, or punitive damages.
8. Changes
We may update these Terms. Material changes will be announced in-app or by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
